1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website at appbranch.co and the mobile applications published by App Branch, LLC ("App Branch," "we," "our," or "us"). By accessing or using our services, you agree to these Terms. If you do not agree, do not use the services.

2. Description of Service

App Branch publishes mobile applications, currently including:

• Astraea: PCOS & Period Tracker: a cycle and symptom record built for PMOS (the condition long called PCOS). It shows cycle windows estimated from your own recorded cycles, and includes symptom logging, sourced readings, a meal scanner that estimates glycemic load, "Ask", which answers questions from sourced guidance and your own log, and a doctor visit file.
• Smart Scan X: a document scanner and PDF toolkit with OCR, ID-card mode, PDF merge/split and printing.

Each app may include optional features that integrate with third-party services (such as Apple Health, Sign in with Apple, cloud storage providers or print services). Use of those features is subject to the third party's terms.

Where an app publishes terms of its own (for example, Astraea at pcoshealth.app/terms), those terms also apply to that app and control where they differ from these Terms.

3. Not Medical Advice (Astraea)

Astraea is an informational cycle and symptom record intended for general wellness and self-monitoring. It is not a medical device and does not provide medical advice, diagnosis, treatment, clinical screening, or contraception.

Cycle windows and the chance-of-pregnancy view are estimates drawn from the records you enter. They are not a method of birth control and must not be relied on to prevent or achieve pregnancy. Content Astraea generates automatically, such as answers from Ask, meal scanner readings and dinner suggestions, may be inaccurate or incomplete and is not medical advice; a meal reading is not a blood sugar measurement.

Always consult a qualified healthcare professional for medical questions, before starting or stopping any treatment, and before relying on the app in any safety-critical context.

4. User Responsibilities

You agree to:

• Use the services only for lawful purposes and in compliance with applicable law.
• Not interfere with, disrupt or attempt to gain unauthorized access to the services.
• Not reverse engineer, decompile or otherwise attempt to derive source code, except to the extent applicable law expressly permits.
• Respect the intellectual property rights of App Branch and others.
• Provide accurate information when required.

5. Intellectual Property

The services, including software, design, text, graphics and trademarks ("App Branch", "Astraea", "Smart Scan X" and the corresponding logos), are owned by App Branch or its licensors and are protected by copyright, trademark and other intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

6. User Content

You retain ownership of the content you create or import into the services (such as scanned documents in Smart Scan X or health logs in Astraea). You grant App Branch a limited, worldwide, royalty-free license to process and store that content solely to operate the services for you. We do not use your content to train third-party machine learning models.

7. Privacy

Our handling of personal information is described in our Privacy Policy. By using the services, you acknowledge that policy.

8. Subscriptions and Payments

Some features (for example, Astraea Full) require an auto-renewing subscription processed through Apple's App Store, which may begin with a free trial. Pricing, billing, trial and renewal terms are disclosed at the point of purchase. Subscriptions, including those that begin with a free trial, auto-renew unless cancelled in your App Store account at least 24 hours before the end of the current period. Refunds, where available, are handled by the App Store under Apple's published policies.

9. Disclaimers

The services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the services will be uninterrupted, secure, error-free, or that any specific result will be obtained from their use.

10. Limitation of Liability

To the maximum extent permitted by law, App Branch and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, use, goodwill or other intangible losses, arising out of or in connection with your use of the services. Our aggregate liability for any claim relating to the services will not exceed the greater of (a) the amount you paid App Branch for the services in the twelve months before the claim arose, or (b) US$50.

11. Termination

We may suspend or terminate your access to the services at any time if you violate these Terms or if we discontinue a service. You may stop using the services at any time. The provisions of these Terms that by their nature should survive termination — including ownership, disclaimers and limitations of liability — will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we make a material change, we will revise the "Effective Date" above and, where appropriate, give additional notice. Your continued use of the services after the new Terms take effect constitutes acceptance of the changes.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the services will be brought exclusively in the state or federal courts located in Delaware, and you and App Branch consent to personal jurisdiction in those courts. Nothing in this section waives consumer rights that cannot be waived under your local law.
